Citi announced Tuesday that it will update its policies to ensure clients can access the firm's financial services despite their political views or involvement in the firearms industry.
 
The bank's decision comes following actions by the Trump administration to counter alleged "debanking" of conservatives, crypto firms and other businesses such as firearms dealers who have lost access to financial services because of their views or their connection to disfavored industries. 

"Citi has always been fully committed to treating all current and potential clients fairly and we have policies, procedures and controls in place for this express purpose," Edward Skyler, head of enterprise services and public affairs at Citi, wrote in a post. "At the same time, we appreciate the concerns that are being raised regarding 'fair access' to banking services, and we are following regulatory developments, recent Executive Orders and federal legislation that impact this area."  

"In light of those developments, we took an objective look at our policies and practices with the intent of striking the right balance between our commitment to fair and unbiased access to our products while continuing to manage all risks to the bank appropriately," he explained.

"We will update our employee Code of Conduct and our customer-facing Global Financial Access Policy to clearly state that we do not discriminate on the basis of political affiliation in the same way we are clear that we do not discriminate on the basis of other traits such as race and religion," Citi said. 

"This will codify what we’ve long practiced, and we will continue to conduct trainings to ensure compliance."


Citi's announcement also addressed its previous policy on firearms, which it explained was a means of ensuring retailers follow best practices in terms of selling guns.

"We also will no longer have a specific policy as it relates to firearms. Our U.S. Commercial Firearms Policy was implemented in 2018 and pertained to the sale of firearms by our retail clients and partners," Citi said. 

"The policy was intended to promote the adoption of best sales practices as prudent risk management and didn’t address the manufacturing of firearms," Skyler wrote. "Many retailers have been following these best practices, and we hope communities and lawmakers will continue to seek out ways to prevent the tragic consequences of gun violence."

Congress is weighing legislation that would prevent financial institutions from debanking clients over purported "reputational risk" from disfavored industries.

Senate Banking Committee Chair Tim Scott, R-S.C., introduced the Financial Integrity and Regulation Management (FIRM) Act in March. The bill would eliminate references to reputational risk as a measure used by regulators to determine the safety and soundness of a financial institution.

During a Thursday hearing, former Democratic vice-presidential candidate Gov. Tim Walz (D-Minn.) was brutally grilled by Republican lawmakers for his past comments likening Immigration and Customs Enforcement agents to the "Nazi Gestapo." Walz appeared alongside Democratic Govs. JB Pritzker of Illinois and Kathy Hochul of New York to testify on sanctuary cities before the House Oversight Committee. During the hearing, Majority Whip Tom Emmer (R-Minn.) confronted Walz for comments he made during a commencement ceremony in May where he said, "Donald Trump's modern-day Gestapo is scooping folks up off the street." 'Inflammatory rhetoric such as yours ... is responsible for putting a target on the back of every ICE agent who is risking their life to protect our communities.' The insinuation Walz made is that federal law enforcement agencies under the direction of President Donald Trump are like the Nazi secret police deployed by Adolf Hitler. "When you said the words 'modern-day Gestapo,' you were referring to ICE agents," Emmer said. "Gestapo, by the way, sir, was the official secret police of Hitler's Nazi Germany. So, you're calling ICE agents modern-day Nazis." Walz stammered at Emmer's confrontation and failed to address his past comments. "It saddens me that you refuse to express regret from comparing ICE to Nazis," Emmer said. "ICE agents are brave Americans who get up every morning, leave their families, and put their lives in harm's way to protect our country, sir. You, at the very least, owe an apology to these dedicated public servants." As President Donald Trump's Department of Homeland Security works to clean up the illegal immigration crisis caused by the former Biden administration, a leaked internal memo from the department named several "open borders politicians" who allegedly defended "illegal alien rapists, murders, [and] pedophiles." The unclassified memo accused progressive politicians of prioritizing illegal immigrant criminals and violent rioters over law enforcement and their American citizen constituents, citing the recent destructive and violent protests in Los Angeles, California, last week. 'ICE, get the f**k out of LA so that order can be restored.' "Since June 6, thousands of violent rioters protesting [Immigration and Customs Enforcement] operations in Los Angeles have assaulted law enforcement officers with concrete chunks and Molotov cocktails, attacked federal buildings, burned cars, and destroyed other public and private property throughout the city," the leaked memo read. "Still, open borders politicians have consistently defended, excused and denied the violence." The DHS accused the leftist politicians of attempting to blame the lawless protests on ICE. The department's internal document listed several Democratic politicians: former Vice President Kamala Harris, California Governor Gavin Newsom, Los Angeles Mayor Karen Bass, Senator Chris Murphy of Connecticut, and Representatives Alexandria Ocasio-Cortez of New York and Maxine Waters of California. Additionally, it referred to Rep. Norma Torres of California but mistakenly listed her as "Yvette Torres." The DHS included quotes from each of the individuals to support its claims that the politicians "put Americans last" by defending illegal alien criminals. It quoted Harris stating, "Demonstrations in defense of our immigrant neighbors have been overwhelmingly peaceful." The memo noted that Newsom, during his June 10th address to California, said, "[Trump's] administration is pushing mass deportations, indiscriminately targeting hardworking immigrant families, regardless of their roots or risk. What's happening right now is very different than anything we've seen before." A comment attributed to Bass read, "Stop the raids. There is a real fear in Los Angeles right now. Parents, workers, grandparents, young people scared to go about their daily lives. We are a city of immigrants. Washington is attacking our people, our neighborhoods, and our economy. "The DHS quoted Sen. Murphy stating, "This is a moment where we have to be on the streets all over the country. ... [President Trump is] trying to turn a protest that is pretty small into something that involves an even bigger confrontation." It included a comment from Ocasio-Cortez that read, "It is 100% carrying water for the opposition to participate in this collective delusion that Dems for some reason need to answer for every teen who throws a rock, rather than hold the Trump admin accountable for intentionally creating chaos and breaking the law to stoke violence." "ICE, get the f**k out of L.A. so that order can be restored," Torres was cited as saying. Waters was quoted as stating, "Don't think that somehow, because they called out the National Guard, there was violence. There was no violence." DHS noted that ICE arrested "murderers, rapists, pedophiles, and other heinous scumbags" during the Los Angeles operation. The department stated that the leftist politicians have continued to "stand firmly with foreign nationals invading America and causing mayhem" and therefore "do not care about the American people's safety or law enforcement." The DHS added that the politicians' policies would "never put America first" and that they are "squarely on the side of criminal illegal aliens." "The Trump Administration will always put the American people first and defend law enforcement working to keep America safe," the department concluded. SPECIAL REPORT: ATF fixing minor issues but ignoring major problems by Lee Williams The ATF wants former gun dealers to know that if their Federal Firearm License was suspended, revoked or denied they are now “invited to reapply.” The ATF claims that every new FFL application will now be judged by an “Administrative Action Policy,” whatever that means. The ATF did not respond to questions about the new program, which is typical. They would not say how many former gun dealers have applied to have their FFLs reinstated, or how many former FFLs have actually been reinstated. Krissy Y. Carlson, ATF’s senior industry advisor/liaison, wrote in an email that she was “forwarding your questions to our public affairs division.” Then, an unsigned email from ATF’s public affairs division demanded an official FOIA request containing the questions, which was sent Wednesday. However, the ATF has still not responded to two previous FOIA requests, which were each sent more than three years ago. It is clear that the ATF would rather issue broad public statements about its internal policy changes than answer a few specific questions, despite its new promise of “fairness and transparency.” “ATF is committed to fairness and transparency in its regulatory enforcement program and to protecting Americans’ Second Amendment rights while also protecting public safety,” the agency now boasts on its website. None of ATF’s recent changes were based on any internal decisions, but were instead the result of President Donald J. Trump, who issued an executive order February 7, titled “Protecting Second Amendment Rights.” The FFL rule was not the only new item announced on ATF’s new page. ATF also claims its Zero Tolerance Policy has been reviewed and replaced “with a new administrative action policy,” whatever that means. “The new policy provides a fair framework for addressing violations uncovered by a compliance inspection, particularly when those violations do not impact public safety,” the ATF claims. This “fair framework” was certainly never part of Joe Biden’s insane Zero Tolerance Policy, which raised the bar to impossible heights by punishing human error. Simple paperwork mistakes that would have barely merited a mention before Biden took office triggered hundreds of FFL revocations. Before Biden, the ATF revoked an average of 40 FFLs per year. But in just the first year that Biden occupied the White House, the ATF revoked 273 FFLs, and many more dealers ended up losing their licenses and livelihoods. For gun dealers, Biden’s Zero Tolerance Policy was likened to the death penalty for a minor traffic offense. Most will celebrate that it’s gone, at least for the next several years. ATF’s real victims The ATF should do nothing—take no official action—until they repair the lives that they destroyed carrying out Biden’s illegal orders. There are far too many real victims that we know about, and probably hundreds more who never reached out for help. Quite frankly, no one really cares how former gun dealers can get relicensed until the ATF is held accountable for the atrocities it committed for years under the Biden administration, and the lives they ruined are made whole. Here are some examples: Russell Fincher, who is from the small town of Tuskahoma, Oklahoma, needed three jobs just to make ends meet. He taught high school history, served as a Baptist minister and sold guns and ammunition out of a small shed in the backyard. For reasons that are still not known, Fincher somehow came to the attention of the ATF. A story published last year chronicled how 15 heavily armed ATF agents raided Fincher’s home, handcuffed him on his deck and then yelled, screamed and threatened the 52-year-old man—in front of this 13-year-old son—until he “voluntarily” surrendered his FFL. The ATF agents seized dozens of Fincher’s personal firearms, which he estimated were worth more than $50,000. Fincher’s Federal Public Defender negotiated a plea agreement, in which Fincher pled guilty to selling ammunition to a prohibited person, which is punishable by up to 15 years imprisonment and a $250,000 fine. Prosecutors dismissed the two remaining charges once Fincher signed the plea agreement. The deal kept Fincher out of prison. Both sides agreed that three years of probation would be “the appropriate disposition of the case.” The plea agreement also specified that Fincher would not contest the forfeiture of 39 personal firearms. His crime? Ficher was accused of selling a box of ammunition to a convicted felon, even though no licensed gun dealers in Oklahoma run background checks for ammunition purchases. Mark “Choppa” Manley is a gun owner, a gun collector and a Second Amendment advocate who had more than 70 legally owned firearms stored in a gun safe at his Baltimore home. All of his firearms complied with both federal law and the laws of Maryland. He was always very careful about that, but that didn’t matter to ATF agents who raided his Baltimore home last year. The Baltimore home of Mark “Choppa” Manley was mistakenly raided by ATF Agents last year. His wife (not pictured) and their three children (pictured) were home during the early morning ATF raid. ATF agents busted down several doors to his home and threw two stun grenades—including one at his juvenile son. More than a dozen ATF agents ransacked Manley’s home. “They threatened to blow up my gun safe,” Manley said at the time. “I don’t have anything to hide, so I told them I’d open the safe. They uncuffed me and told me ‘Don’t try to run.’ Where was I gonna run to? My family was right there.” Manley unlocked his gun safe and slowly swung open the door. “They were all standing around waiting and hoping,” he said “This was their moment, they thought. They started pulling out rifles and shotguns, but everything was registered and Maryland-compliant. ‘We got nothing here,’ one of them said.” Manely and his 17-year-old daughter were each handcuffed. His wife and children were moved to the rear of a SWAT van. It was 20-degrees outside, and they were only wearing pajamas. “I would like you to take the handcuffs off my daughter,” Manley’s wife told the ATF agents. “Why did you handcuff my husband? He complied with everything you asked for.” ATF agents left after they found nothing illegal. The Manley family was never told, at least officially, why they were mistakenly targeted by the ATF. David Schieferle, who spent 20 years as a U.S. Air Marshal, served eight months behind bars in the Miami Federal Detention Center—which he described as a “hellhole”—10 months on home confinement wearing an electronic ankle monitor, and is currently on probation for the next two-and-a-half years. Yet, he’s still willing to risk even more time behind bars through a new trial by claiming his first attorney was incompetent and that he never broke any law. The ATF screwed me over,” he told the Second Amendment. “What HSI (Homeland Security Investigations) and the ATF did to me was wrong. Every ATF person involved in my case seemed evil.” Schieferle’s life-altering saga began when he was called into the Federal Air Marshal’s office on his day off to be interrogated. Little did he know that the ATF and other federal agencies had dozens of agents positioned in cars, ATVs and even a helicopter, who were awaiting a “go” order to invade his five-acre organic farmstead and home. Said Schieferle: “If I had to venture my best guess at what happened during my trial, the ATF reluctantly admitted the tubes were legal. The problem was the DOJ was allowed to convince a clueless jury that I intended to use or convert the tubes into illegal silencers. The DOJ won this trial by using innocent gun data on my hard drives and by not allowing me to present to the jury any evidence nor my expert witness to give his full testimony. I never did anything illegal, and I never took one step or thought to convert anything into a silencer.” Patrick “Tate” Adamiak committed no crime, so why is he serving a 20-year sentence at a federal prison in New Jersey? Because the ATF screwed up and would rather charge an innocent man and force him to serve two decades behind bars than admit the truth—that their special agents don’t have a clue about what they’re doing. Adamiak, who is now 31, was just a 28-year-old E-6 in the U.S. Navy prior to his arrest. He enjoyed firearms and ran a website that sold gun parts—not guns. He was always extremely careful about what he sold. After all, he had to protect his naval career, which was doing extremely well. Adamiak had already been accepted into Naval Special Warfare, so exciting things were soon headed his way. But after their informant lied and dozens of heavily armed ATF agents kicked open Adamiak’s door during a search warrant, nothing illegal was found. As a result, the ATF was forced to call in their ringer, Firearms Enforcement Officer Jeffrey Bodell. Once the ATF turned the case over to Bodell, Adamiak’s innocence no longer mattered. Bodell would break the rules. Under oath, he actually turned toys into firearms, legal RPGs into destructive devices and 100% legal semi-autos into machineguns. Despite Bodell's claims, items like inert RPGs, toy STENs, submachinegun receivers, and open-bolt semi-autos are still sold legally online. The RPGs, toy STENs and submachinegun receivers don’t require any paperwork to purchase. Despite Bodell’s and the ATF’s untruths, an anti-gun judge crippled Adamiak’s defense. One of his defense experts, an actual former ATF official, wasn’t even allowed to testify much. As a result, Adamiak was found guilty and sentenced to 20-years in prison, even though everything he possessed is still completely legal and that he had never committed any crime. Bryan Malinowski had never been charged with any crime. When the ATF raided Malinowski’s West Little Rock home last year they were spoiling for a gunfight, and they got one. As a result, a good man is dead—the latest victim of ATF’s overly aggressive tactics and complete disregard for the sanctity of human life. Little Rock airport executive director Bryan Malinowski, 53, was shot and killed in his home last year during an early morning ATF search warrant. ATF never commented officially about the killing, other than to claim Malinowski fired first. But Malinowski’s family released a statement, which confirms what everyone already knew: It is extremely unlikely that the 53-year-old airport executive knew he was trading gunfire with federal agents. It is far more likely Malinowski believed he was defending himself and his wife from armed home invaders. His widow, Maria “Maer” Malinowski, recently filed a lawsuit, which accused the ATF and 10 agents and task force officers of violating hers and her husband’s constitutional rights. “The Constitution requires reasonableness and, specifically here, that defendants both knock and announce their presence and purpose and wait a reasonable time before entry,” the lawsuit states. “The ATF failed to do so, resulting in an entirely predictable, needless and tragic outcome.” Takeaways The ATF has never learned from its mistakes. Neither Ruby Ridge, Waco nor any of these bad searches and arrests taught them anything. Therefore, the ATF will continue making bad arrests and using excessive force, and more Americans will be injured and killed. That much is certain. In fact, it’s guaranteed. President Donald J. Trump can fix this very easily. All he needs to do is decide whether he wants the type of scrutiny that an unchecked ATF will bring to his administration. President Trump needs to understand that unless the ATF and its leadership are finally held accountable, only one question still remains: Who will the ATF shoot next? San Antonio Man Sentenced to More than 12 Years in Federal Prison for Trafficking Firearms U.S. Attorney's Office, Western District of Texas SAN ANTONIO – A San Antonio man was sentenced in a federal court in San Antonio to 151 months in prison for firearms trafficking. According to court documents, Joel Alejandro Martinez aka Bo Jackson, 26, was identified by the Bureau of Alcohol, Tobacco, Firearms and Explosives as being a frequent seller of stolen firearms in online chat groups. On Jan. 10, 2024, Martinez posted two pistols for sale and agreed to sell them at a location in San Antonio. He stated that he did not have a car but his mother, codefendant Margarita Hernandez Martinez, would drive him. On Feb. 28, 2024, at the agreed upon time, Martinez arrived at the location, driven by his mother, and unloaded a black rifle case from the truck, placed it in the backseat of the purchaser’s vehicle, and got in the front seat of the purchaser’s car. The purchaser gave Martinez $1,100 in cash for the .308 caliber rifle. Later that day, Martinez contacted the purchaser to ask what else they might be interested in purchasing. The purchaser, an undercover ATF agent, indicated that they purchase all sorts of firearms but also deal in “cheap throwaways stolen.” Martinez responded to the undercover agent, “I got you,” and indicated that he could supply AR-style rifles and pistols. He later told the undercover that he purchased stolen or crime-involved guns in large batches and agreed to sell four pistols to the undercover for $1,600. In another conversation, the agent told Martinez that he, “buys them for cheap and will move them to Mexico.” The undercover agent met with Martinez—driven by his mother—three more times between March 5, 2024 and April 11, 2024, to conduct sales of firearms, at least one of which Martinez knew and had reasonable cause to believe was stolen. Martinez’s mother, Hernandez Martinez, was sentenced on April 25 to 40 months in prison for aiding and abetting. Federal District Court Judge Jason K. Pulliam sentenced both defendants. U.S. Attorney Justin R. Simmons for the Western District of Texas made the announcement. The ATF investigated the case. Assistant U.S. Attorney Zack Parsons prosecuted the case. Georgia Man Sentenced to Prison for Illegally Possessing Machinegun at Hospital Friday, June 6, 2025 U.S. Attorney's Office, Middle District of Georgia Defendant, a Rap Musician Known as Quez 2RR, Had Stolen Weapon in Labor and Delivery; Federal Case Linked to Ongoing Metro Atlanta Shooting Investigation MACON, Ga. – A Henry County resident who had a stolen Glock 9mm handgun with a loaded 30-round extended magazine capable of converting to a fully automatic weapon while at the Labor and Delivery unit of a hospital was sentenced to serve more than five years in prison—above federal sentencing guidelines—for his crime. Terrell Monquez Searcy, 21, of McDonough, Georgia, was sentenced to serve 66 months in prison to be followed by three years of supervised release by U.S. District Judge Tilman E. “Tripp” Self on June 4. Searcy previously pleaded guilty to one count of possession of a machinegun on March 21, 2025. There is no parole in the federal system. “Holding people found in possession of machineguns and with illegal conversion devices accountable for breaking federal law remains a top priority in the Middle District of Georgia,” said Acting U.S. Attorney C. Shanelle Booker. “This case exemplifies how law enforcement and prosecutors work together to effectively remove illegal firearms and other dangerous destructive devices from the streets in order to make our communities safer.” “Machinegun conversion devices are fueling a deadly uptick in gun violence, turning routine firearms into weapons of war," said ATF Acting Assistant Special Agent in Charge Thomas Crawford of the Atlanta Field Division. "This case is yet another example of why ATF is committed to aggressively identifying and removing these illegal devices from our communities." According to court documents, the stipulation of facts and other statements made in Court, Monroe Police Department officers were dispatched to Piedmont Walton Hospital on Aug. 17, 2023, after a nurse observed Searcy in a Labor and Delivery room with a handgun, which is prohibited in the hospital. When hospital security came to the room, Searcy admitted he did have a handgun and that he put it under the couch cushion. He gave the firearm—a Glock Model 17 9mm handgun with a loaded 30-round extended magazine—to security and remained in the room. Hospital security noticed that a full auto sear pin appeared to have been attached to the rear of the slide, making the firearm a machinegun, prompting the call by hospital security to police. Police ran the serial number on the firearm and found out it was reported stolen from Walton County, Georgia. Searcy was taken into custody. ATF agents tested the firearm and confirmed it did function as a machinegun. Further investigation revealed that Searcy, a rapper known as Quez 2RR, had showcased a pistol with what appeared to be a machinegun conversion device in music videos on a YouTube channel. In a music video titled “Traffic,” Searcy rapped, “I pop out a switch on the back of my Glock” and “I put a switch on the back of my Glock, just to clean up the street when it’s time for that action.” At one point in the video, Searcy’s holding a pistol in his waistband with what appears to be a machinegun conversion device attached to the back. Following the federal indictment charging Searcy with possessing a machine gun in August 2024, agents located Instagram messages between Searcy and a female law enforcement officer with the Clayton County Police Department. Between January and March 2023, Searcy asked the police officer to run his information to see if there were any warrants for his arrest. The police officer also provided information to Searcy regarding an active homicide investigation. During an interview with Clayton County Police Department detectives, the officer admitted to providing Searcy with information on an active homicide investigation and advising Searcy when she located active warrants for his arrest. On Feb. 11, 2025, members of the ATF, McDonough Police Department and Henry County Sheriff’s Office executed a federal search warrant at Searcy’s residence in McDonough, Georgia. Searcy and two other men were in the home along with several firearms. The defendant told agents that he had been living at the residence for a couple of months, that he slept with a Draco firearm under his bed and that the Glock 17 found in the living room belonged to him. ATF agents submitted test fires from both firearms to the National Integrated Ballistic Information Network (NIBIN) to determine if either firearm had been used in other crimes. The Micro Draco recovered from Searcy’s bedroom returned with several NIBIN leads, including two from the DeKalb County Police Department. Both DeKalb County incidents indicated that the Micro Draco was used in a drive-by shooting in DeKalb County where four people, including two juveniles, were shot inside their homes. Each shooting occurred within just days of Searcy receiving information from the Clayton County police officer on the active Clayton County homicide where his friend was shot and killed. The Bureau of Alcohol, Tobacco, Firearms and Explosives (ATF) investigated the case, with assistance from the City of Monroe Police Department, Clayton County Police Department, McDonough Police Department, Henry County Sheriff’s Office, the Dekalb County Police Department and the Piedmont Walton Hospital Security Department. Arcadia Felon Given Five-Year Consecutive Sentence For Selling Firearms To Undercover ATF Agent Monday, June 2, 2025 U.S. Attorney's Office, Middle District of Florida Tampa, Florida – U.S. District Judge Thomas P. Barber has sentenced Roger William Clayton (41, Arcadia) to five years in federal prison for possessing a firearm as a convicted felon. This sentence will run consecutively to a nine-year sentence Clayton is currently serving in Florida state prison for methamphetamine trafficking. Clayton pleaded guilty on January 14, 2025. According to court documents, on July 28, 2022, Clayton sold five firearms to an undercover ATF agent in Arcadia. Clayton directed the undercover agent to meet him near Southwest Lettuce Lake Avenue and County Road 761, where Clayton revealed the firearms for sale. The firearms included a Ruger Mini-14 .223 caliber rifle, a Mauser 6.5 caliber rifle, a VZ24 6.5 caliber rifle, a Tokarev 7.62mm caliber pistol, and a Romarm-Cugir 7.62mm pistol. Clayton advised the undercover agent that he could also facilitate the sale of suppressors or silencers and “ghost guns” – also known as privately manufactured firearms which cannot be traced. At the time, Clayton had multiple prior felony convictions including grand theft, grand theft of a motor vehicle, trafficking in stolen property, possession of a place for the purpose of trafficking, fleeing and eluding a law enforcement officer, and robbery. As a convicted felon, he is prohibited from possessing firearms or ammunition under federal law. This case was investigated by the Bureau of Alcohol, Tobacco, Firearms and Explosives and the DeSoto County Sheriff’s Office. It was prosecuted by Assistant United States Attorneys David W.A. Chee and Michael J. Buchanan. This case is part of Project Safe Neighborhoods (PSN), a program bringing together all levels of law enforcement and the communities they serve to reduce violent crime and gun violence, and to make our neighborhoods safer for everyone. On May 26, 2021, the Department launched a violent crime reduction strategy strengthening PSN based on these core principles: fostering trust and legitimacy in our communities, supporting community-based organizations that help prevent violence from occurring in the first place, setting focused and strategic enforcement priorities, and measuring the results. Smoke Shop Robbery Foiled In Norwalk, California, a smoke shop owner was confronted by four armed men attempting to rob his store. When the owner resisted, one of the robber's pepper-sprayed him. The shop’s co-owner then came to his business partner’s aid, drawing his firearm and shooting one of the robbers in the chest. The criminals fled the scene, but the wounded robber collapsed in a nearby alley. Police transported him to a local hospital, where he later died. In Review Every state has different laws regarding self-defense, but here is my analysis of this case: Legal: In California, deadly force is justified when a person reasonably believes he or she is in danger of death or great bodily harm and the threat is apparent, present and immediate, requiring an instant response. The threat was apparent in the form of four armed men and became immediate when one of them pepper-sprayed the smoke shop’s owner. The store’s co-owner responded immediately to defend his business partner. As of the time of writing, no charges have been filed. Tactical: It’s likely the defender had some form of self-defense training. He demonstrated tactical patience by waiting until his business partner was pepper-sprayed and the robbers were distracted before drawing his handgun and opening fire. He also refrained from pursuing the criminals as they fled the store, again indicating that he was likely trained in appropriate defensive response. Training: It’s hard to argue against the tactics the co-owner employed. He exercised tactical patience by not drawing immediately in the face of a gun already pointed at him.
